By downloading, installing, accessing, or using the Bopx mobile application (the "App"), developed and owned by Bopx Labs (referred to as "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable federal, state, and local laws and regulations of the United States. If you do not agree to these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you and Bopx Labs governing your use of the App. Your continued use of the App after any modifications to these Terms will constitute your acceptance of such modifications.
Bopx is a privacy-first photo and video management application designed to store, organize, edit, and manage photos and videos exclusively on your mobile device. The core features include, but are not limited to:
All media and data managed by the App remain exclusively on your device unless you explicitly choose to export or back up the data to external storage or services. We do not host, store, or process your media on any cloud servers or third-party infrastructure.
You must be at least 13 years of age to use the App, in compliance with the Children's Online Privacy Protection Act (COPPA) of the United States. If you are under the age of 18, you must have the legal consent of your parent or legal guardian to use the App.
You represent and warrant that you are legally capable of entering into binding contracts and that your use of the App complies with all applicable laws and regulations in your jurisdiction, including but not limited to federal and state privacy laws, intellectual property laws, and data protection laws.
Bopx does not require the creation of an account, username, or password to access and use the App. All functionality is available without account registration. You are solely responsible for maintaining the security of your device and any optional App lock settings you enable (passcode, Face ID/Touch ID).
You retain full ownership and control of all photos, videos, and other media content ("Content") that you import, capture, or store within the App. We do not claim any ownership rights to your Content. You represent and warrant that:
You agree not to engage in any of the following prohibited activities while using the App:
The App, including all software, code, design, text, graphics, logos, and features, is protected by United States copyright, trademark, patent, and other intellectual property laws. All intellectual property rights in the App are owned by Bopx Labs or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App except as expressly permitted in these Terms.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOPX LABS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not guarantee the accuracy, completeness, or usefulness of any features or functionality of the App, nor do we guarantee that the App will meet your specific requirements. Your use of the App is at your sole risk.
TO THE MAXIMUM EXTENT PERMITTED BY UNITED STATES LAW, BOPX LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE APP; (ii) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR DEVICE OR CONTENT; (iii) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (iv) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY; (v) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE APP; AND (vi) THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY.
IN NO EVENT SHALL BOPX LABS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE AMOUNT OF FIFTY DOLLARS ($50) IF APPLICABLE LAW PERMITS SUCH LIMITATION.
You agree to indemnify, defend, and hold harmless Bopx Labs, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in California to resolve any legal matter arising from these Terms.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice (e.g., through the App or via email if you have provided contact information) prior to the change becoming effective. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the App.

These Terms constitute the entire agreement between you and Bopx Labs regarding your use of the App and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and Bopx Labs.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect.
